How
the Means Testing process works is, you provide us with COPIES (only) of a lot
of documentation that we need to review your case, along with your answers to
a questionnaire, all of which will be provided by email.
The information is to be MAILED to Larry's paralegal, Kathy Roberts, at:
P.O. Box 355029
Palm Coast, FL 32135
Take your time in completing these.
Be very exact and write neatly. If something does not
apply to you, do NOT leave it blank. Instead, write
"N/A" so
we know you didn't skip it. Follow the directions carefully.
Once
we have reviewed everything, we can determine whether
you can file chapter 7 or have to file chapter 13.
If you make below a certain pre-determined level, you
can automatically file chapter 7. If you make more
than that amount, then we have to see if your debts
are primarily "consumer" in nature. If
so, then you must file chapter 13 if your income is
high enough to pay back at least a certain amount or
a certain percentage of your creditors. If you can't
pay that much, or if your debts are not primarily "consumer" in
nature, then you can probably file chapter 7. (Do not
worry what all these amounts are; it is very confusing
and that is our job to worry about).
Other than the
work on your part in getting us all the information
we request, it really is not a difficult or painful
experience and you will enjoy a certain euphoria upon
its completion.
